WE ARE LEGAL DOCUMENT ASSISTANTS (LDAs)

Our staff of legal document assistants (or LDAs), are experienced professionals who are authorized under California law to prepare legal documents for consumers at the direction of the client. LDAs are not attorneys and cannot provide legal advice or represent a client in court. LDAs are however licensed and bonded professionals who can enable individuals to represent themselves in their own legal matters by ensuring that their papers are properly prepared, filed, and served.

 

HOW WE DIFFER FROM PARALEGALS

Many of our LDAs have paralegal backgrounds. However, unlike paralegals, who must work under the direction of an attorney, be compensated by an attorney, and are not required to be separately licensed or bonded, LDAs are required to be registered and licensed by the state and file a bond; LDAs, therefore, are not required to be associated in any way with an attorney—or an attorney’s fee structure—in order to provide document preparation assistance to the general public.

As registered and bonded LDAs, we are authorized and able to provide legal information, resources, and document preparation services to any consumer who is handling his or her own legal matter. We can help you prepare a large variety of legal documents including, but not limited to, the following:


  1. INCORPORATION— We can provide the forms, help you complete them, take the papers to the Secretary of State and return them to you. In other words, we can help with everything you’ll need to legally incorporate and open a corporate bank account.


  2. FICTITIOUS NAME FILING— A fictitious business name, or DBA (“doing business as”), allows you to legally do business using a name other than your own personal name. We can provide the form, help you complete it, have the document recorded at the county recorder, and then return a certified copy to you.

  3. DEEDS— There are many types of deeds. We can help you decide which one is appropriate for your situation, provide the necessary form, have the deed recorded with the county recorder, then return a conformed copy to you.

  4. DIVORCE— If your divorce is not extremely complicated, our document preparation assistants can help you begin and complete your own divorce at a fraction of the cost an attorney would charge for comparable work.

  5. FAMILY LAW FILINGS— Besides divorce, family law matters can involve such things as restraining orders, paternity questions, and child custody and support issues to name only a few. Our LDAs are able to help with many of these domestic matters.

  6. NAME CHANGE— We can provide the forms, help you prepare them, then file the documents at the appropriate court — everything you’ll need in order to obtain an order legally changing your name.

  7. TEMPORARY RESTRAINING ORDERS— These court orders allow individuals to be legally protected from other individuals and are enforced by law enforcement agencies. We can provide the forms, help you prepare them, serve the individual to be restrained, and deliver a copy of the order to the appropriate law enforcement agency. We also provide a Proof-of-Service to you.

  8. SMALL CLAIMS ASSISTANCE— We can help you with your entire small claims case, from forms, to Proof-of-Service upon the defendant, to judgment, to writ, and beyond. We tailor our assistance and fee strictly to your individual needs.

  9. SUMMONS AND COMPLAINT— Most civil law suits begin with the preparation, filing, and service of a summons and complaint. It is the initial pleading on the part of the plaintiff (the complaining party). The most common summons and complaint filed by individuals who are not attorneys is that involving unlawful detainer actions or eviction proceedings. We can help you obtain the forms, prepare them, file them, and serve these documents upon the defendant (the party against whom the complaint is being made).

  10. ANSWER— This document is the defendant’s (individual or entity) written response to a legal action filed against him, her, or it by the plaintiff. The most common answers filed by individuals who are not attorneys relate to eviction proceedings (unlawful detainers) filed against them by landlords. We can provide the forms, help prepare them, and then file the answer with the appropriate court.

  11. ABSTRACTS— These documents are issued by the court following a money judgment. Their purpose is to allow interested parties, such as credit rating agencies and escrow companies, to discover whether or not an individual owes money on a judgment. Until the money is paid, most escrows cannot close. We can provide the form, help prepare it, have it issued by the court, and most importantly, have it recorded at the county recorder.

  12. WRITS— These documents are issued by the court after a judgment has been entered for the plaintiff. The most common writs allow judgment creditors to levy against an individual’s or entity’s bank account and/or wages. We can provide the forms, help prepare them, have the writ issued, and then serve the writ upon the entity to be levied.

  13. COLLECTIONS— Here, we can help you with all your small claims needs; the small claims court is the resource most individuals use in order to collect on debts involving $7,500 or less. The collection of money often involves the use of writs, abstracts, and ORAPs, all of which we can help you with.

  14. JUDGMENTS— Whether it involves money or divorce, we can help you with the preparation of your judgment papers as well as file the document with the appropriate court. We can also help you with collection regarding money judgments; here, we can help you obtain writs, abstracts, and ORAPs.

  15. ORAPs— The “order for appearance of a judgment debtor” is issued by the court following money judgments upon submission of the necessary forms. It allows creditors to interrogate debtors regarding their assets in a court sanctioned format. Here, we can help you obtain, fill-out, and have the ORAP issued by the appropriate court. We can also serve the ORAP upon the debtor.

  16. NOTICE TO QUIT—This form usually involves landlord/tenant issues such as non-payment of rent, nuisance, 30-day notice to move out, 3-day notice to pay rent or quit, and so on. We can provide the appropriate form, help you prepare it, then serve the notice and provide you with a Proof-of-Service in a very rapid fashion (usually within 24 hours).

  17. UNLAWFUL DETAINER/EVICTION— See summons and complaint.

  18. SUBPOENAS— Subpoenas for individuals allow you to order individuals to appear at court hearings as witnesses. Subpoenas for records allow you to obtain records from individuals or entities necessary for your case. We can help you prepare your subpoenas, serve them, and provide you with a Proof-of-Service in a timely fashion.
